Privacy Policy

Last updated: 26 October 2026

FOMO exists to help real encounters happen, and real life requires safety. This policy explains what personal data we collect, why we collect it, and the choices and rights you have. We wrote it in plain language. If anything is unclear, write to us at support@gofomo.ai.

1. Who we are

FOMO is operated by Villa Hampe SL, a company established in Spain (“FOMO”, “we”, “us”). We are the data controller for the personal data described in this policy, which means we decide how and why it is processed.

This policy applies to our website and the FOMO app (together, the “Service”). We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and Spanish data protection law (Ley Orgánica 3/2018, LOPDGDD).

2. Data we collect

We only collect what we need to make the Service work for you. You stay in control of what you share and with whom.

Data you give us

  • Account data — your name, email address, password (stored in hashed form), and profile details such as a photo, if you choose to add one.
  • People and circles — the contacts you add, the circles (“bubbles”) you create and their members, and plans or invitations you create, accept or decline.
  • Availability and preferences — when you are free, the kinds of plans you enjoy, and your social energy settings, if you choose to share them.
  • Communications — messages you send to us, for example support requests and feedback.

Data you choose to connect

  • Calendar — if you connect a calendar, we read free/busy information to suggest good moments to meet.
  • Contacts — if you grant access to your device contacts, we use them to help you find and invite people you know.
  • Location — if you enable it, approximate or precise location helps suggest convenient places and times to meet.

Each of these is optional and can be switched off at any time in your device or app settings.

Data collected automatically

  • Usage data — how you interact with the Service, such as features used and suggestions accepted or dismissed.
  • Technical data — IP address, device and browser type, operating system, language, and diagnostic and crash logs.

Data about other people

When you add someone to FOMO or invite them to a plan, we process limited information about them (such as their name and contact details). Please only share information about others where you have a reasonable basis to do so. People who are not FOMO users can ask us to delete their information at any time.

3. How we use your data

  • To create and manage your account and provide the Service.
  • To suggest moments, people and plans that fit your rhythm, availability and energy.
  • To send invitations, reminders and notifications you have asked for.
  • To keep the Service safe and secure, and to prevent fraud and abuse.
  • To understand how the Service is used so we can fix problems and improve it.
  • To respond to your questions and support requests.
  • To comply with our legal obligations.

What we don’t do: we do not sell your personal data, and we do not use it for third-party advertising. Our success is measured in real encounters, not time spent in the app.

4. Legal bases for processing

Under the GDPR we rely on the following legal bases:

PurposeLegal basis
Providing the Service, managing your account, sending invitationsPerformance of a contract (Art. 6(1)(b) GDPR)
Calendar, contacts and location access; optional notificationsYour consent (Art. 6(1)(a) GDPR), which you can withdraw at any time
Security, fraud prevention, improving the Service, processing limited data about people you inviteOur legitimate interests (Art. 6(1)(f) GDPR), balanced against your rights
Keeping records required by law (e.g. tax and accounting)Legal obligation (Art. 6(1)(c) GDPR)

5. AI agents and automated suggestions

FOMO uses AI agents that work in the background to learn your patterns, notice relationships that may be fading, spot low-friction moments to meet, and adapt to your energy. These agents only propose — they never decide for you, and nothing happens without your action.

We do not make decisions based solely on automated processing that produce legal or similarly significant effects on you. Where we use third-party AI providers to generate suggestions, they process data on our behalf under contract and are not permitted to use your data to train their own models.

6. Who we share data with

  • Other users, as you direct — for example, the people in a circle or plan see what you choose to share with them.
  • Service providers (processors) — companies that help us run the Service, such as hosting and infrastructure, database, email delivery, analytics and AI processing. They act on our instructions under data processing agreements.
  • Authorities — where required by law, or to protect the rights, safety and property of our users or others.
  • Business transfers — if FOMO is involved in a merger, acquisition or sale of assets, personal data may be transferred subject to this policy.

7. International transfers

Some of our service providers are located, or process data, outside the European Economic Area (EEA), including in the United States. When this happens we make sure appropriate safeguards are in place, such as an adequacy decision by the European Commission (including the EU–US Data Privacy Framework) or the European Commission’s Standard Contractual Clauses. You can ask us for more information about these safeguards.

8. How long we keep data

We keep personal data only for as long as we need it for the purposes described in this policy:

  • Account data is kept while your account is active. When you delete your account, we delete or anonymise your data within 30 days, except where we must keep it longer by law.
  • Connected data (calendar, contacts, location) is deleted when you disconnect the source or withdraw consent.
  • Technical logs are kept for a limited period, typically no longer than 12 months.
  • Records required by law are kept for the period the law requires.

9. Your rights

Under the GDPR you have the right to:

  • Access the personal data we hold about you and receive a copy.
  • Rectify inaccurate or incomplete data.
  • Erase your data (“right to be forgotten”).
  • Restrict how we process your data.
  • Data portability — receive your data in a structured, machine-readable format.
  • Object to processing based on our legitimate interests.
  • Withdraw consent at any time, without affecting processing carried out before withdrawal.

To exercise any of these rights, email support@gofomo.ai. We will respond within one month. We may ask you to verify your identity before acting on your request.

You also have the right to lodge a complaint with a data protection supervisory authority. In Spain this is the Agencia Española de Protección de Datos (AEPD), www.aepd.es. You may also contact the authority in the EU country where you live or work.

10. Security

We use technical and organisational measures to protect your data, including encryption in transit, access controls, and limiting access to people who need it. No system is completely secure, but we work to protect your information and will notify you and the relevant authorities of a data breach where the law requires.

11. Children

The Service is not intended for children under 16. We do not knowingly collect personal data from children under 16. If you believe a child has provided us with personal data, please contact us and we will delete it.

12. Cookies and similar technologies

We use strictly necessary cookies and local storage to keep you signed in and make the Service work. Our website loads fonts from Google Fonts, which means your browser connects to Google’s servers and shares your IP address with them. If we introduce non-essential cookies, such as for analytics, we will ask for your consent first where required by law.

13. Changes to this policy

We may update this policy from time to time. When we do, we will change the “Last updated” date above, and if the changes are significant we will let you know in the app or by email before they take effect.
